These Terms & Conditions ("Terms") govern your access to and use of the Estivlo website, platform, services, features, content and related offerings (collectively, the "Service"). By accessing or using Estivlo, creating an account, purchasing credits or otherwise using the Service, you acknowledge that you have read, understood and agreed to these Terms. If you do not agree with these Terms, please do not use Estivlo.

1. About Estivlo

Estivlo is an AI-powered personal styling platform designed to provide personalized fashion guidance based on information and preferences provided by users. The Service may include conversational styling, personalized fashion recommendations, Fashion Plans, saved styling conversations, Style Profiles, styling sessions, credit-based access and other features introduced from time to time. This website, Estivlo, is owned and operated by Casmir.

The commercial brand name "Estivlo" does not, by itself, constitute a separate legal entity. The Service is operated by the legal entity identified in these Terms.

2. Acceptance and Eligibility

By using Estivlo, you confirm that:

You are legally capable of entering into a binding agreement in your jurisdiction;
You are at least 18 years old, or have otherwise reached the age of majority applicable to you;
The information you provide to Estivlo is accurate to the best of your knowledge;
You will use the Service in accordance with these Terms and applicable laws.

Estivlo is intended for adults. We do not knowingly provide services to children who are below the applicable age of consent or majority.

3. Your Estivlo Account

Certain features require you to create or maintain a registered account. You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account. You agree not to:

Create an account using false or misleading information;
Impersonate another person;
Share your account credentials with another person;
Attempt to access another user's account;
Create multiple accounts for the purpose of bypassing usage limits or other restrictions;
Use another person's account or credits without permission.

You should notify Estivlo if you believe your account has been accessed without your permission.

4. Guest and Registered Access

Estivlo may provide different levels of access depending on whether you use the Service as a guest or as a registered user. Guest users may receive a limited number of styling sessions or interactions without creating an account. Registered users may receive additional functionality, including access to a Style Profile, saved Fashion Plans, conversation history and a defined number of styling sessions within the applicable usage period. The specific limits and features applicable to each access level may be displayed on the Estivlo website and may change from time to time. Estivlo may apply reasonable safeguards to prevent abuse, automated misuse or attempts to circumvent usage limits.

5. AI-Powered Styling Services

Estivlo uses artificial intelligence and related technologies to generate fashion recommendations, styling suggestions, Fashion Plans and other content. AI-generated recommendations are intended to provide general fashion and styling guidance. Estivlo does not guarantee that every recommendation will be suitable, accurate, complete, current or appropriate for every individual, occasion, climate, cultural setting, dress code or personal circumstance. You remain responsible for deciding whether a recommendation is appropriate for you. AI-generated content may occasionally contain errors, omissions, unexpected suggestions or information that does not accurately reflect your preferences. You should use your own judgement before relying on any recommendation.

6. No Guarantee of a Particular Styling Result

Estivlo is designed to assist with personal styling decisions. It does not guarantee that you will achieve a particular appearance, social outcome, professional outcome, level of confidence or other result from following a recommendation. Fashion is subjective, and individual preferences, body characteristics, fit, availability, sizing, product quality and other factors can affect the final result. Where Estivlo refers to products, brands, prices, availability or other third-party information, that information may change and may not always be current.

7. Fashion Plans

Estivlo may allow registered users and eligible users to create and save Fashion Plans. Fashion Plans may include multiple outfit recommendations, styling notes, accessories, footwear, practical considerations, budget guidance and other fashion-related suggestions. Fashion Plans are generated based on information available to Estivlo at the time of creation. Estivlo does not guarantee that a Fashion Plan will remain appropriate if your circumstances, preferences, destination, weather, event requirements, budget or other relevant conditions change.

8. Style Profiles and Personalization

Registered users may provide information about their personal style, including preferences relating to fit, colours, aesthetics, lifestyle, occasions, destinations and budgets. This information may be used to personalize the Estivlo experience. You are responsible for ensuring that information you provide is appropriate for use by the Service. The handling of personal information is governed by our Privacy Policy, which forms part of these Terms.

9. Styling Credits and Pay-As-You-Go Purchases

Estivlo may offer paid styling credits on a pay-as-you-go basis. Credit packs may differ in price, number of styling sessions and other characteristics. The applicable price and number of credits will be displayed before you complete a purchase. Unless explicitly stated otherwise, purchasing a credit pack does not create a subscription or recurring payment arrangement. Credits purchased through Estivlo are intended for use within the Estivlo platform and do not represent cash, stored monetary value or an electronic payment instrument. Credits cannot be exchanged for cash or withdrawn as money.

10. Gifted Credits

Estivlo may provide credits to users free of charge at its discretion. Gifted or promotional credits may be provided to family members, friends, beta testers, promotional recipients, partners, influencers, customers or other users. Unless otherwise stated at the time of issuance, gifted credits are provided solely for use within Estivlo and have no cash value. Estivlo may impose specific conditions, limitations or expiry dates on promotional credits where these are communicated at the time they are issued. Gifted credits may not be sold, exchanged for money or transferred to another account unless Estivlo expressly permits such transfer.

11. Payments

Payments for paid Estivlo services may be processed through third-party payment providers, including PayPal, Wise or other payment providers made available by Estivlo from time to time. Payment processing may be subject to the applicable terms, conditions, fees, policies and privacy practices of the relevant payment provider. Estivlo does not receive or store payment card details where those details are processed directly by the relevant payment provider. You are responsible for providing accurate payment information and ensuring that you are authorized to use the selected payment method.

12. Prices and Taxes

Prices displayed on Estivlo will be presented in the applicable currency and may be subject to applicable taxes, duties, payment-provider charges or other legally applicable charges. Where applicable, taxes may be calculated or displayed during the payment process. Estivlo reserves the right to change its prices, credit-pack structures or offerings at any time. Any change will not affect a purchase that has already been successfully completed, except where required by applicable law.

13. Refunds

Estivlo's paid styling credits are intended to provide access to digital services and are generally non-refundable once purchased or credited to an account, except where a refund is required under applicable law or is otherwise expressly approved by Estivlo. Because Estivlo's PAYG credits are purchased for access to digital styling services, users should review the selected credit pack, price and applicable terms before completing payment. This policy does not limit any mandatory consumer rights that cannot legally be excluded.

14. Credit Usage

Credits may be consumed when you use eligible paid styling services.

The number of credits required for a particular service may be displayed by Estivlo before use.

Estivlo may maintain records of credit purchases, gifts, usage and adjustments to maintain an accurate account balance.

If an account is found to have received credits incorrectly due to a technical error, fraudulent activity, abuse or other unauthorised action, Estivlo may correct the relevant account balance.

15. User Content and Conversations

Users may provide text, preferences, descriptions, questions and other information through Estivlo ("User Content"). You retain your rights in User Content to the extent provided by applicable law. By submitting User Content to Estivlo, you grant Estivlo the permissions reasonably necessary to process that information for the purpose of providing, maintaining and improving the Service, subject to our Privacy Policy and applicable law. You are responsible for ensuring that User Content does not:

Infringe another person's intellectual property or privacy rights;
Contain unlawful material;
Contain malicious code or harmful software;
Misrepresent another person;
Facilitate fraud, abuse or unlawful activity.

16. Prohibited Use

You may not use Estivlo to:

Violate any applicable law or regulation;
Attempt to gain unauthorised access to the Service or its systems;
Circumvent usage limits or security controls;
Interfere with the operation of the website;
Use automated systems, bots or scripts to abuse the Service;
Reverse engineer or attempt to extract proprietary systems or models;
Scrape or systematically collect Estivlo content without permission;
Fraudulently obtain or manipulate credits;
Abuse payment systems;
Impersonate Estivlo, its employees or other users;
Use the Service for activities that are unlawful, fraudulent, abusive or harmful.

Estivlo may suspend or restrict access where it reasonably believes these Terms have been violated.

17. Intellectual Property

The Estivlo name, logo, branding, website design, software, interface, original content, graphics, text, functionality and other materials provided by Estivlo are owned by or licensed to the operator of Estivlo and are protected by applicable intellectual property laws. You may use Estivlo for your personal, non-commercial use in accordance with these Terms. You may not reproduce, modify, distribute, sell, publicly display, commercially exploit or create derivative works from Estivlo's proprietary materials without prior written permission.

18. Third-Party Services

Estivlo may integrate with or rely on third-party services, including website infrastructure, authentication, AI technology, analytics and payment providers. Third-party services may have their own terms and privacy policies. Estivlo is not responsible for the independent operation, availability, policies or practices of third-party services. Where a payment or other transaction takes place through a third-party provider, that provider's terms may also apply.

19. Service Availability

We aim to keep Estivlo available and reliable, but we do not guarantee uninterrupted or error-free operation. The Service may occasionally be unavailable because of:

Maintenance;
Technical issues;
Software updates;
Security incidents;
Third-party service interruptions;
Network or infrastructure failures;
Circumstances beyond our reasonable control.

Estivlo may modify, suspend or discontinue features or parts of the Service where reasonably necessary.

20. Account Suspension and Termination

Estivlo may suspend, restrict or terminate an account where:

These Terms have been violated;
Fraudulent or abusive activity is suspected;
Payment-related abuse occurs;
The Service is being used unlawfully;
Security or operational risks require action;
Required by law or a competent authority.

Users may stop using Estivlo at any time. Where applicable, termination of an account may result in the loss of access to saved conversations, Fashion Plans, unused credits or other account-associated content, subject to applicable law and any rights that cannot legally be excluded.

21. Disclaimer of Warranties

To the maximum extent permitted by applicable law, Estivlo is provided on an "as available" and "as is" basis. We do not warrant that:

The Service will always be available;
AI-generated recommendations will always be accurate;
Fashion information will always be current;
Recommendations will always meet your expectations;
The Service will be completely free from errors or interruptions;
Every feature will remain available indefinitely.

Your use of AI-generated styling recommendations is at your own discretion.

22. Limitation of Liability

To the maximum extent permitted by applicable law, Estivlo and its operator shall not be liable for indirect, incidental, special, consequential or punitive losses arising from your use of, or inability to use, the Service. This may include losses arising from reliance on styling recommendations, third-party products, product availability, sizing, purchasing decisions or other outcomes resulting from information provided through Estivlo. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.

10. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Estivlo, its operator, affiliates and relevant personnel from claims, losses, liabilities, damages and expenses arising from:

Your violation of these Terms;
Your misuse of the Service;
Your User Content;
Your violation of another person's rights;
Fraudulent or unlawful activity associated with your account.

24. Privacy

Your use of Estivlo is also governed by our Privacy Policy. The Privacy Policy explains how Estivlo may collect, use, store and otherwise process personal information and other data associated with your use of the Service. By using Estivlo, you acknowledge that you have read the Privacy Policy.

25. Changes to These Terms

We may update these Terms from time to time to reflect changes to the Service, business practices, technology, legal requirements or other circumstances. When we make material changes, we may provide notice through the website, your account or another reasonable method. Your continued use of Estivlo after updated Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by applicable law.

26. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of India, unless applicable law requires otherwise. Any dispute arising in connection with these Terms or the Service shall be subject to the jurisdiction of the courts having appropriate jurisdiction over the legal entity operating Estivlo, subject to any mandatory consumer or other legal rights applicable to you.
